Reference to our previous two INFOs on the subject of ONCR/Show Cause Notices, issued by PCAA to our members, it is further apprised that PALPA sought legal advice from our legal counsel.
As per the advice, we have been able to reach an understanding that our affected members must follow the required procedure, which is “an appeal to competent authority under section 375 of CARs-1994 of PCAA” against the impugned orders.

375. Redress of grievance. Any person aggrieved by an order passed or action taken by the Director-General, or the Authority, under these rules may appeal to the Federal Government and the Federal Government shall have the power to modify or annual the order appealed against, or issue direction to the Director-General or the Authority, as the case may be, as to the manner in which such action is to be taken by them. Provided that this power shall not be available to the Federal Government in respect of any matter where the Director-General has certified that the exercise of the power would have a direct adverse effect on flight safety.

You are therefore requested to file your personal appeal by seeking help from the attached sample/format.
In addition to the assurances already received from the Directorate of Flight Operations, this step will further ward off the chances of any adverse action by the PCAA against non-payment of financial penalty.
On behalf of PALPA, it is strongly recommended that in the absence of the DGCAA, it would be in the best interest of our affected members that their appeal must reach Aviation Division for a favorable outcome, which PALPA is already expecting.
